Elderly Parent Scammed

Question:

Help! My elderly parent was just scammed out of their money and they have run up all of their credit cards.  What do I do?

Answer:

The first thing would be to get a durable power of attorney in place so you can immediately stop the scams and the excessive charges.

The second thing would be to file bankruptcy to discharge the credit card debt.  Usually, elderly parents are on a fixed income and can therefore qualify for Chapter 7 bankruptcy.

After the case is over, in approximately 90 to 120 days from filing date, the matter is resolved and no creditors can back later to harass or sue the parent. 

Remember, you may not have gotten your parent into their financial situation, but you are getting them out of it in the quickest most mutually-beneficial way possible.
