Who I am

Allow me to introduce myself. My name is Denise A. True and I help people and small businesses file bankruptcy. I have been a licensed attorney for over 20 years, with a focus on bankruptcy law since 2009. I have assisted thousands of people obtain financial freedom through the filing of a bankruptcy. My cases range from complex small business cases to less complex consumer cases and everything in between.

How my clients feel

Many people feel guilty about having to file bankruptcy, but I have a "no judgment policy” in my office. It either makes financial sense to file bankruptcy or it does not. I remind my clients often that sometimes bad things happen to good people and there is no sense beating yourself up over past financial difficulties. The bankruptcy code was created to help people break out of their debt shackles and move on to more productive uses for their money, such as a small business owner with the ability to employ workers or an average Joe who can actually start saving for retirement.

How the process works

Many people, including attorneys, are unfamiliar with the bankruptcy process as well as the protections that are afforded by the filing of a bankruptcy. Don’t worry. I will explain it to you. The filing of a bankruptcy prohibits creditors from continuing their collections efforts. This means that creditors must immediately stop their harassing phone calls, texts, emails and letters. Most legal proceedings, repossessions, and foreclosures are also halted by a bankruptcy filing. For some, the desire not to be hounded day and night by their creditors is the driving force in deciding to file bankruptcy. The range of creditors that can be discharged in a bankruptcy include: credit card debt, old tax debt, personal loans, lawsuits, medical debts, pay day loans, judgments, prior mortgages and repossessed vehicles.

Saving my clients’ possessions

Folks often wonder whether they will lose all of their stuff if they file for bankruptcy, and that simply could not be farther from the truth. In Texas, the exemptions are quite generous, which means for most people, they will have no problem protecting their house, car, retirement accounts, wages, clothes, furniture, and tools of the trade. Sometimes, people come to me after they have spent their life’s savings, including their retirement funds, only to find out that funds in a retirement account are protected. I say often that I wish my clients would come to me sooner, so I could help them protect more of their assets.
